These Terms of Service ("Terms") govern your access to and use of the LavishLabs mobile application and website (collectively, the "Service") provided by LavishLabs LLC ("LavishLabs," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. We may modify these Terms at any time, and your continued use constitutes acceptance of the modified Terms.

2. Description of Service

LavishLabs provides an AI-powered furniture discovery service that analyzes photos of your space to recommend furniture products from third-party retailers. The Service includes room analysis, furniture matching, price comparison, AR visualization, and related features.

IMPORTANT: LavishLabs is a product discovery and recommendation service. We do not sell furniture directly. All purchases are made through third-party retailers who have their own terms, policies, and customer service. See our AI Disclaimer for more information.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription and Payments

Some features require a paid subscription. By subscribing, you agree that:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your account settings
• Refunds are provided in accordance with our refund policy
• Prices may change with notice

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Upload photos that you do not have the right to share
• Upload photos containing inappropriate or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Transmit viruses or malicious code
• Scrape, copy, or harvest data from the Service
• Impersonate any person or entity
• Use the Service for commercial purposes without authorization
• Share your account credentials with others

6. Intellectual Property

The Service, including all content, features, AI models, and functionality, is owned by LavishLabs LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. User Content

You retain ownership of photos and content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content to provide and improve the Service. You represent that you have the right to submit such content and that it does not violate any third party's rights.

8. Third-Party Retailers

LavishLabs provides links to third-party retailer websites. We are not responsible for:

• The accuracy of product listings, prices, or availability
• The quality of products purchased from third parties
• Shipping, returns, or customer service from retailers
• Any transactions between you and third-party retailers

Your interactions with retailers are governed by their terms and policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OF AI RECOMMENDATIONS, ROOM MEASUREMENTS, OR FURNITURE MATCHING.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAVISHLABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR PURCHASES MADE THROUGH LINKED RETAILERS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless LavishLabs LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Nassau County, New York.

14. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If we cannot resolve the dispute within 30 days, either party may proceed with formal dispute resolution.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and AI Disclaimer, constitute the entire agreement between you and LavishLabs LLC regarding the Service.
